Plain-English summary
These terms govern your use of the arca.biz website. They’re not the same as the merchant agreement you’d sign to open an Arca account — that’s a separate document with its own terms covering processing, fees, disputes, and your relationship with the sponsor bank.
By using this site you’re agreeing to these terms. If you don’t agree, don’t use the site.
Who can use the site
arca.biz is intended for business users in the United States considering payment processing services. You must be at least 18 years old and authorized to inquire on behalf of any business you reference in a form. If we suspect misuse, we may block access at our discretion.
Acceptable use
You agree not to:
- Submit false information in any form.
- Use the site or its forms to send spam, phishing attempts, or unauthorized advertising.
- Scrape, crawl, or otherwise extract data from the site in a way that disrupts service.
- Reverse-engineer, decompile, or otherwise attempt to derive source from compiled assets.
- Use the site to violate any law, regulation, or third-party right.
- Interfere with the security or operation of the site (e.g., attempting to bypass rate limits, exploiting vulnerabilities).
Account and submissions
arca.biz does not require an account to browse. When you submit a form (pricing inquiry, statement comparison, contact), you authorize Arca to use the information you provided to respond to that inquiry, in accordance with our Privacy policy and the TCPA disclosure.
Any merchant account you open with Arca will be governed by a separate merchant agreement executed at account opening. Those terms control the processing relationship — including fees, settlement, disputes, and the sponsor-bank relationship — and supersede anything on this site in case of conflict.
Intellectual property
The arca.biz site, its design, its copy, and the Arca name and logo are owned by Arca or its licensors. You may not copy, modify, or distribute the site or its materials without written permission, except as needed for normal browser caching and printing.
Clover®, Clover Mini®, Clover Flex®, Clover Go®, and Clover Station Duo® are registered trademarks of Clover Network, LLC. References to third-party apps on the Clover App Market use those vendors’ trademarks under nominative fair use to describe compatibility with Clover hardware. No endorsement or partnership is implied beyond Clover’s marketplace relationship.
Third-party content and links
The site contains links to third-party websites (Clover’s app marketplace, vendor pages, arcapayment.com, and others). Arca is not responsible for the content, accuracy, or privacy practices of those sites. Visiting them is at your own risk and subject to their terms.
Disclaimers
The site is provided “as is” without warranty of any kind. Specific rates, fees, eligibility criteria, hardware specifications, and feature availability shown on the site are subject to change and final confirmation in your written proposal and merchant agreement. We do our best to keep the site accurate, but the binding terms are the ones you sign, not the ones on this page.
Pricing examples (effective rates, savings calculators, dual pricing math) use industry-typical assumptions and are not guarantees of your specific outcome.
Limitation of liability
To the maximum extent permitted by law, Arca is not liable for indirect, incidental, or consequential damages arising from your use of arca.biz. This site is informational; the binding limitations of liability for the processing relationship live in the merchant agreement.
Indemnification
You agree to defend and indemnify Arca against claims arising from your misuse of the site or violation of these terms.
Termination
We may suspend or terminate your access to the site at any time, with or without notice, for any reason consistent with applicable law. Sections that by their nature survive (intellectual property, disclaimers, limitation of liability, governing law) survive termination.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising from your use of the site (separate from any merchant agreement) will be brought in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts.
Changes to these terms
We may update these terms from time to time. Material changes will be posted on this page with an updated “last updated” date. Continued use of the site after a material change constitutes acceptance of the revised terms.
